Terms of Service
These terms apply when you use the Bloomelle website and when you buy our products. Please read them carefully. By using the site or placing an order you agree to these terms. Nothing here affects your statutory rights as a consumer under UK law.
1. Who we are
Bloomelle is a UK-based direct-to-consumer food supplement brand. In these terms, "we", "us" and "our" mean Bloomelle. You can contact us at any time at anna@bloomelle.co.
2. Using our site
You may use our site for lawful purposes only. You must not misuse the site, attempt to gain unauthorised access, interfere with its security features, or use it to transmit anything unlawful or harmful. We may withdraw or change the site, or restrict access, without notice, and we are not liable if the site is unavailable at any time.
3. Products and descriptions
We take care to describe our products accurately, including their ingredients and intended use. Images and packaging are for illustration and colours may appear slightly differently on your screen. Bloomelle is a food supplement and is not a medicine. It is not intended to diagnose, treat, cure or prevent any disease, and it should not be used as a substitute for a varied, balanced diet and a healthy lifestyle. Always read the label. If you are pregnant, breastfeeding, taking medication or have a health condition, please speak to your GP or pharmacist before use. Nothing on our site is medical advice.
4. Orders and pricing
When you place an order you are making an offer to buy. A contract is formed when we send you an email confirming that your order has been dispatched. Prices are shown in pounds sterling and include VAT where applicable. Delivery costs are shown before you pay. We try to keep pricing accurate, but if we discover an error in the price of goods you have ordered we will contact you to confirm whether you wish to continue at the correct price. We may refuse or cancel an order, for example if the item is out of stock or if we suspect fraud, and we will refund any payment taken.
5. Subscriptions and recurring payments
If you choose a subscription, you authorise us to take recurring payments for each delivery at the interval and price shown at checkout. There is no minimum term. You can pause or cancel your subscription at any time through your account or by emailing anna@bloomelle.co, with no cancellation fee. To avoid being charged for the next delivery, please make any change before your next billing date, which is shown in your account. If you cancel after an order has been dispatched, that order still stands, but no further payments will be taken. Your right to cancel individual orders and our Refund Policy continue to apply.
6. Delivery
We deliver within the UK. Estimated delivery times are given in good faith but are not guaranteed. Risk in the goods passes to you when they are delivered to the address you gave us.
7. Cancellations, returns and refunds
Your right to change your mind, our 90-day money-back guarantee, and how we handle faulty or incorrect items are set out in full in our Refund Policy, which forms part of these terms.
8. Your account
If you create an account, you are responsible for keeping your login details secure and for activity under your account. Please give us accurate, current information and keep it up to date so we can fulfil your orders and contact you when needed.
9. Reviews and submissions
If you send us reviews, comments or other content, you confirm it is your own and lawful, and you grant us a non-exclusive right to use it in connection with our business. We may edit or remove content that is unlawful, misleading or offensive. We do not have to publish or respond to submissions.
10. Intellectual property
The content on our site, including text, images, logos and the Bloomelle name, belongs to us or our licensors and is protected by law. You may not copy, reproduce or exploit it without our written permission.
11. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer. Subject to that, we are not liable for losses that were not reasonably foreseeable, or for business losses, as our products are supplied for personal use only.
12. Third-party links
Our site may link to third-party sites or use third-party services. We are not responsible for the content or practices of those third parties.
13. Privacy
How we collect and use your personal data is explained in our Privacy Policy.
14. Changes to these terms
We may update these terms from time to time for legal, regulatory or operational reasons. The version on this page at the time you place an order applies to that order.
15. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the non-exclusive jurisdiction of the courts of England and Wales.
